Ghana BREAKING News: Supreme Court upholds SP Martin Amidu’s appointment in 5-2 majority ruling

The Supreme Court of Ghana has upheld the appointment of Martin Amidu as Special Prosecutor at the age of 66 following a suit placed before it.

In a 5-2 majority decision, the Supreme Court dismissed the motion filed by former deputy Attorney General Dominic Ayine.

The judges who were in favour of the dismissal include, Chief Justice Anin Yeboah, Justices Bafffoe Bonnie, Marfo Sau, Nene Amegatse and Prof Ashie Kotey.

The two judges who dissented are Justices Sulley Gbadegbe and Agnes Dodzi.

Dr. Ayine filed the case to seek “a true and proper interpretation of Articles 190(1)(d), 199(1), and 295 of the 1992 Constitution, the retirement age of all holders of public offices created pursuant to Article 190 (1)(d) is sixty (60) years, and not beyond sixty-five (65) years.

Dr. Ayine argues at the time President Akufo-Addo named Martin Amidu as SP , he was not qualified because he was at the age of 66. He said this contravenes section 13(3) of the Office of the Special Prosecutor Act, 2018 (Act 959).

The detailed ruling of the court outlining reasons for the judgement is expected later tomorrow, May 14th, 2020.
