According to testimony given in court by a witness for the Peoples Democratic Party (PDP) and its presidential candidate, Atiku Abubakar, neither he nor President Bola Tinubu of the All Progressives Congress (APC) are eligible to be recognized as the nation’s leader because they did not receive a majority of the votes cast in the Federal Capital Territory (FCT), according to Daily Trust.
Only Peter Obi, the presidential candidate for the Labour Party, received more than 25% of the vote in FCT during the election on February 25 among the three leading candidates for the March 2023 presidential elections.
The Independent National Electoral Commission’s (INEC) attorney, Mohammed Aliyu, testified under cross-examination on Monday, June 5, and the witness reportedly stated that the required 25 percent was a requirement to be declared president.
When the witness was questioned by Aliyu SAN, he was told that it was based on the constitutional clause and that it wasn’t his personal view.
When asked if his candidate received the necessary outcome in the FCT, he responded, “My candidate did not score 25% of votes in the FCT by the purported result published by INEC.”
